General Terms and Conditions (GTC)
of LM Tours di Muth Linda
§ 1 Scope and Contractual Partners

These General Terms and Conditions (GTC) apply to all contracts regarding guided scooter tours and related services concluded between LM Tours di Muth Linda, Via Umberto Primo 12, 64027 Sant'Omero (TE), Italy (hereinafter referred to as the "Provider") and the customer (hereinafter referred to as the "Customer").

The contractual partner is the sole proprietorship LM Tours di Muth Linda.
§ 2 Conclusion of Contract and Payment Conditions

The presentation of the tours on the website or in promotional media does not constitute a legally binding offer, but rather a non-binding invitation to book.

By booking (whtasapp or via email), the Customer submits a binding offer. The contract is only concluded upon the transmission of the written booking confirmation by the Provider.

The total price must be paid in advance (advance payment). Payment must be made via PayPal (lmtoursabruzzo@gmail.com) or by bank transfer to the business account specified in the contract, stating the booking number, last name, and first name of the Customer.

An additional fee of applies for an extra passenger.
§ 3 Requirements for Participation (Drivers)

Every driver must be at least 21 years old on the day of the tour.

Citizens of the European Union, the United Kingdom (UK), and Switzerland are permitted to drive the 125 cc scooters with a valid category B car driver's license. Citizens of other countries strictly require a category "A" or "A1" driver's license (motorcycle).

The driver's license must always be carried in its original form during the ride.

A strict zero-tolerance policy applies to alcohol (0.0 ‰ blood alcohol level) as well as an absolute ban on intoxicating substances before and during the ride. In case of violations, the participant will be immediately excluded from the tour without any right to a refund.

Children may participate as passengers from a minimum height of 1.40 m.
§ 4 Services of the Provider

The scope of services is defined in the booking confirmation and the service contract. Standard services include the provision of 1 ready-to-use scooter (125 cc) for the duration of the tour, accompaniment by a qualified, locally experienced tour guide, and the safety equipment provided (helmets, hygienic under-helmet cap) including fuel for the tour.
§ 5 Cancellation and Withdrawal by the Customer

Cancellation by the Customer is free of charge exclusively up to 48 hours before the agreed start of the tour. Cancellations must be submitted in text form (e.g., via email).

In the event of a cancellation made less than 48 hours before the start of the tour or in the case of a no-show at the agreed appointment, the Customer shall have no right to a refund. In this case, the full total price (100%) will be retained.
§ 6 Cancellation by the Provider (Weather Clause)

The Provider reserves the right to cancel the tour in the event of unsuitable or dangerous weather conditions (e.g., heavy rain, storm).

In this case, the Customer will primarily be offered an alternative date or a full refund of the amount paid. Further claims for compensation are excluded.
§ 7 Liability and Damages (Helmet Clause)

The tour price includes statutory third-party liability insurance (RCA).

Exception for Equipment: If a helmet or other safety equipment provided falls, is damaged, or is lost, this is not covered by the insurance. The resulting damage must be paid in full by the Customer (renter) themselves.

For material and financial damages, the Provider shall only be liable in cases of intent or gross negligence.
§ 8 Data Protection (Privacy)

The processing and storage of personal data take place in full compliance with the General Data Protection Regulation (GDPR) and are described in detail in the Provider's separate privacy policy.
§ 9 Applicable Law and Place of Jurisdiction

This contract is governed by the law of the Republic of Italy.

The place of jurisdiction for all disputes arising from this contractual relationship is Teramo, Italy.
