PRIVACY POLICY

in accordance with Art. 13 of the EU General Data Protection Regulation (GDPR) and the Italian Privacy Code (D.Lgs. 196/2003 and subsequent amendments)

With this privacy policy, the Data Controller informs you about the processing of your personal data in the context of inquiries, bookings (specifically via the WhatsApp messaging service), and the execution of the guided scooter tour.

2. Purposes of Data Processing & Legal Basis

We process your data (name, address, date of birth, driver's license details, e-mail address, telephone/mobile number, chat and booking history, payment details, and, if applicable, photos and video recordings) for the following purposes:

  • Contract Performance & Pre-contractual Measures (Art. 6 Abs. 1 lit. b GDPR): To process inquiries, manage bookings (including communication and booking acceptance via the WhatsApp messaging service), provide the scooters, and contact you on short notice in the event of weather-related cancellations.

  • Compliance with Legal Obligations (Art. 6 Abs. 1 lit. c GDPR): To comply with Italian tax, accounting, and insurance regulations.

  • Legitimate Interest (Art. 6 Abs. 1 lit. f GDPR): To ensure fast and customer-oriented communication via modern messaging services, as well as to assert or defend legal claims in the event of damages or accidents.

  • Voluntary Consent (Art. 6 Abs. 1 lit. a GDPR): To take photos and videos during the tour for marketing and promotional purposes (e.g., social media, website, flyers). This processing only takes place if you grant your separate consent at the end of this document.

3. Disclosure of Data and Third-Country Transfer (WhatsApp)

Your data will be treated with strict confidentiality. Data will only be disclosed to third parties if it is strictly necessary for the performance of the contract or due to legal obligations, specifically to:

  • The motor vehicle insurance company in the event of an accident or damage.

  • Our tax advisor (Commercialista) and the competent authorities (Agenzia delle Entrate) to fulfill tax obligations.

  • The public / internet users, provided you have consented to the publication of photos and videos on the internet or social media.

  • WhatsApp / Meta Platforms: When contacting or booking via WhatsApp, message contents and your phone number are transmitted to WhatsApp Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland). It cannot be excluded that data will be transferred to the parent company Meta Platforms Inc. in the USA. Meta is certified under the EU-US Data Privacy Framework, which ensures an adequate level of data protection. Your use of WhatsApp is entirely voluntary; alternatively, you can use traditional communication channels (e-mail, telephone).

4. Storage Period

  • Data required for tax documentation and invoicing will be stored for 10 years in accordance with Italian statutory retention obligations (Art. 2220 Codice Civile).

  • Chat histories and booking data via WhatsApp will be deleted as soon as they are no longer necessary for the purposes for which they were collected (e.g., after full completion of the tour and expiry of warranty periods) and no legal retention obligations conflict.

  • Photos and videos processed on the basis of your consent will be stored for as long as the promotional medium remains online or in use, or until you withdraw your consent.

5. Your Rights as a Data Subject

Under the GDPR, you have the right to access, rectify, erase, and restrict the processing of your data at any time. You can object to the use of the WhatsApp communication channel for the future at any time. You may also withdraw your consent for photo and video recordings at any time with effect for the future.

To exercise these rights, please contact the Data Controller via e-mail. You also have the right to lodge a complaint with the competent Italian data protection authority: Garante per la protezione dei dati personali (Piazza Venezia 11, 00187 Roma, www.garanteprivacy.it).

I confirm that I have read and understood the general privacy policy (including the information regarding data processing for communication and booking via WhatsApp). I consent to my data being processed for the purposes of contract performance and legal obligations.

These materials may be published for promotional purposes on the provider's website, in flyers, and on social media channels (e.g., Instagram, Facebook). I am aware that I can withdraw this consent at any time without formalities via e-mail.
